    Formal identification of a victim

    A formal procedure for the identification of victims of THB was introduced through the Decree No. 417 of the Cabinet of Ministers on “On Approval of the Procedure for the Declaration of the Status of a Victim of Trafficking in Human Beings” and the Decree No. 783 “On Approval of the Procedure for Interaction of Agents for Combating Trafficking in Human Beings”, adopted respectively in May and August of 2012.

    A person who considers her/himself a victim of THB has a right to submit an application to the local state administration to obtain a victim status and prior to the formal decision, s/he has the right to personal security, medical, psychological, legal and other assistance, temporary placement in an institution providing assistance to victims of THB.

    The identification procedure includes an interview with the applicant and the filing of a special questionnaire prepared by the Ministry of Social Policy. The interview is carried out by the responsible person at the local state administration.

    If the applicant has already been identified as a victim of THB by law enforcement authorities or court or has been recognised as a victim by relevant authorities in the destination country an interview is not required.

    After the interview, the official of the local state administration prepares a personal file of the applicant, verifies the accuracy of the information, and transmits the application to the Ministry of Social Policy. The overall time for examination of applications for a victim status should not exceed 30 days from the first interview.

    The Ministry of Social Policy reviews the file and takes a decision on a victim status without any contact with the applicant (this is an official so-called “social” status, which differs from the one a person receives in a criminal proceedings and entitles a person to a range of services provided by state).

    Is the victim willing to report a crime and take part in criminal proceedings?

    The willingness of the victim to take part in the criminal proceedings doesn’t influence the decision of the Ministry of Social Policy in granting victim’ status. Whether victims cooperate with the police or no, they are subject to receiving full package of assistance provided by the state.
